1. Introduction
Welcome to the Swéy Online Store. These Terms of Service, together with any policies referred to in this document, govern your access to and use of the Swéy Online Store, including our website, Shopify storefront, products, checkout process, customer accounts, promotions, communications, and related services. These Terms apply only to the Swéy clothing and apparel online store. They do not apply to the separate Swéy marketplace app, discovery platform, merchant platform, or any third-party marketplace services that may be operated separately by Swéy. The Swéy Online Store is operated by Swey Technologies (Pty) Ltd, referred to in these Terms as “Swéy”,“Swey”, “Swey Online”, “Swey Clothing”, “Swey Clo”, “we”, “us”, or “our”. By visiting our website, browsing products, placing an order, creating an account, subscribing to communications, or otherwise using the Swéy Online Store, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use this website or purchase products from the Swéy Online Store.

3. Policy Hierarchy
These Terms of Service are the main agreement between you and Swey Technologies (Pty) Ltd in relation to the Swéy Online Store. Additional policies, including but not limited to our Shipping Policy, Refund, Returns & Exchanges Policy, Privacy Policy, promotional terms, product care guidance, and any other website policies, are incorporated into these Terms by reference. In the event of any conflict, inconsistency, ambiguity, or discrepancy between these Terms of Service and any supplementary policy, these Terms of Service shall prevail to the maximum extent permitted by applicable law. Where a supplementary policy provides specific operational details, such as shipping timelines, return procedures, or refund steps, that policy will apply only to the extent that it does not contradict these Terms. Nothing in these Terms is intended to remove, restrict, or exclude any mandatory rights that cannot legally be excluded under applicable consumer protection law.
4. Shopify Store Only
The Swéy Online Store is a direct-to-consumer clothing and apparel store. For purchases made through this store, Swey Technologies (Pty) Ltd is the seller of the products. This is separate from any Swéy marketplace app, discovery platform, third-party merchant platform, or social shopping service that may exist now or in future. References to “Swéy” in these Terms refer only to the Swéy Online Store unless expressly stated otherwise.
5. Eligibility to Use the Store
By using this website or placing an order, you confirm that: ● You are at least 18 years old; or ● You are using the website with permission from a parent or legal guardian; and ● You have the legal capacity to enter into a binding agreement; and ● The information you provide to us is accurate, complete, and not misleading. We reserve the right to refuse service, cancel orders, restrict access, or close customer accounts where we reasonably believe these Terms have been breached.
6. Products
Swéy sells apparel and related products, including but not limited to: ● Hoodies ● Shirts ● Daily wear collections ● Limited edition releases ● Apparel accessories ● Future clothing and lifestyle products Products may be available in limited quantities. We reserve the right to modify, discontinue, replace, restock, or remove products at any time without notice. The availability of a product on the website does not guarantee that the product will remain available at a later date.
7. Product Availability
All orders are subject to product availability. While we aim to maintain accurate inventory information, stock errors may occur. If a product becomes unavailable after you place an order, we may offer one or more of the following: ● A refund ● Store credit ● A replacement item ● An alternative size or colour ● A later dispatch date, where acceptable to you We reserve the right to cancel an order where stock is unavailable, incorrectly listed, or affected by an operational error.
8. Product Descriptions and Images
We make reasonable efforts to ensure that product descriptions, images, measurements, colours, materials, specifications, and prices are accurate. However, we do not guarantee that all website content will always be complete, current, or error-free. Product images are provided for illustrative purposes. Minor differences may occur between the product shown online and the product delivered. These differences may relate to lighting, styling, production batches, screen display, photography, fabric texture, fit, or garment finishing.
9. Product Colours
We aim to display product colours as accurately as possible. However, actual colours may vary due to: ● Device screen settings ● Mobile display differences ● Monitor calibration ● Lighting conditions ● Photography ● Editing and image compression ● Natural fabric and production variation Colour variation caused by screen settings, photography, lighting, or display differences is not considered a product defect. We do not accept returns, refunds, or exchanges solely because a customer does not like the colour or because the colour appears slightly different on a screen.
10. Sizing and Fit
Customers are responsible for reviewing product sizing information before placing an order. Sizing preferences are personal and may vary depending on body shape, fit preference, styling preference, and garment design. Swéy is not responsible for incorrect size selections made by customers. Size exchanges may be available in accordance with these Terms and our Refund, Returns & Exchanges Policy, subject to stock availability and return eligibility requirements. Where a size exchange is approved, the product must be unworn, unused, unwashed, in original condition, with original tags attached, and free from stains, odours, perfume, smoke, pet hair, or damage.
11. Product Care
Customers are responsible for following any product care instructions provided on the garment, packaging, product page, or website. Swéy is not responsible for damage caused by: ● Incorrect washing ● Incorrect drying ● Ironing damage ● Bleach or harsh chemicals ● Excessive heat ● Improper storage ● Normal wear and tear ● Misuse or neglect Products damaged due to incorrect care are not considered defective.
12. Personal Notes and Packaging
Some orders may include occasional letters, notes, inserts, packaging details, or brand materials. These additions are provided at Swéy’s discretion and may vary between orders. Such additions do not make the product custom-made or personalised unless expressly stated on the product page.
13. Pricing
Product prices are displayed on the website and may change at any time without notice. We reserve the right to correct pricing errors, typographical mistakes, promotional errors, or technical errors at any time. If a product is listed at an incorrect price, we may cancel the order and refund any amount paid. Prices may exclude shipping fees, customs duties, import taxes, VAT, brokerage fees, or other charges unless expressly stated.
14. Currency
Prices may be displayed in South African Rand or another currency depending on website settings, Shopify settings, payment provider settings, or customer location. Currency conversions, where shown, may be estimates. Your bank, card provider, payment provider, or payment gateway may apply exchange rates, conversion fees, or international transaction fees. Swéy is not responsible for such third-party charges.
15. Taxes, Duties and Import Charges
For South African orders, applicable taxes may be included or applied in accordance with South African law and Shopify checkout settings. For international orders, customers may be responsible for customs duties, import taxes, VAT, brokerage fees, clearance fees, or other charges imposed by the destination country. These charges are the responsibility of the customer unless expressly stated otherwise. Swéy has no control over customs authorities and cannot guarantee customs processing times, clearance outcomes, or customs-related charges.
16. Payment
Payment must be successfully authorised and received before an order can be processed. Payments are processed through Shopify and/or approved third-party payment providers. By placing an order, you agree to provide accurate payment information and confirm that you are authorised to use the selected payment method. We reserve the right to refuse, cancel, hold, or delay an order where: ● Payment cannot be verified ● Fraud is suspected ● A chargeback risk exists ● Billing information appears inaccurate ● The order appears suspicious ● The transaction violates these Terms ● The payment provider flags the transaction
17. Order Confirmation
After placing an order, you may receive an order confirmation email or notification. An order confirmation does not guarantee final acceptance of the order. Final acceptance occurs when the order is processed and dispatched, unless we notify you otherwise. We reserve the right to cancel or refuse any order before dispatch.
18. Order Refusal and Cancellation by Swéy
Swéy may refuse, cancel, limit, or hold an order for any reason, including but not limited to: ● Suspected fraud ● Payment issues ● Pricing errors ● Stock errors ● Shipping restrictions ● Abuse of promotions ● Incorrect customer information ● Suspicious ordering behaviour ● Breach of these Terms ● Operational constraints If an order is cancelled after payment has been received, an appropriate refund will be issued using the original payment method where possible.
19. Customer Cancellation Requests
Customers may contact us to request cancellation of an order. Cancellation requests are not guaranteed. If an order has already been processed, packed, dispatched, or handed to a courier, cancellation may no longer be possible. Where cancellation is not possible, the Refund, Returns & Exchanges provisions will apply.
20. Shipping and Delivery
Shipping and delivery are governed by these Terms and our Shipping Policy. Orders are typically processed and dispatched within 1–3 business days after payment has been successfully received. Orders are not processed, packed, or shipped on weekends or public holidays. During product launches, promotional periods, holiday seasons, or high-volume periods, processing times may be longer than usual. Estimated delivery times are provided for convenience only and are not guaranteed delivery dates.
21. Shipping Destinations
Swéy currently ships within South Africa and to selected international destinations. Shipping availability may vary depending on country, region, courier availability, customs rules, or operational restrictions. We reserve the right to refuse, cancel, or restrict orders to locations that cannot reasonably be serviced.
22. Local Free Shipping in South Africa Only
Free shipping applies only to qualifying local orders delivered within South Africa. Unless expressly stated otherwise, free shipping is available only for South African orders with a qualifying order value of R1,300 or more. International orders do not qualify for free shipping unless Swéy expressly publishes a specific international free shipping promotion. If another policy, page, advertisement, banner, email, or website notice refers to free shipping without specifying the location, it must be interpreted as applying only to qualifying South African orders, unless Swéy expressly states otherwise in writing. Swéy reserves the right to amend, suspend, limit, or discontinue free shipping offers at any time.
23. Shipping Costs
Shipping costs are calculated at checkout based on available shipping methods, destination, order size, courier availability, and Shopify settings. Shipping costs must be paid by the customer unless the order qualifies for a valid free shipping offer. Shipping costs may change at any time.
24. Delivery Estimates
Estimated delivery times may include: ● Gauteng: approximately 5 business days ● Major South African metropolitan areas: approximately 5 business days ● Rural and remote South African areas: approximately 10 business days ● International orders: approximately 21 business days These are estimates only. Delivery may take longer due to courier delays, customs clearance, public holidays, high order volumes, weather events, strikes, government restrictions, or events outside our reasonable control.
25. Shipping Carriers
Swéy may use one or more shipping partners, including but not limited to: ● The Courier Guy ● PostNet ● DHL ● Other approved logistics providers The courier used for an order may depend on the destination, order size, shipping option selected, operational requirements, and courier availability.
26. Tracking
Where available, tracking information will be provided after dispatch. Tracking updates are controlled by the courier and may not appear immediately. Swéy is not responsible for delays in courier tracking updates.
27. Incorrect Shipping Information
Customers are responsible for providing accurate and complete shipping information at checkout. Swéy is not responsible for delays, failed deliveries, lost parcels, return-to-sender events, or additional shipping fees caused by incorrect, incomplete, outdated, or misleading delivery information provided by the customer. If a parcel is returned to Swéy due to incorrect customer information, the customer may be responsible for re-delivery fees.
28. Lost, Delayed or Damaged Parcels
If a parcel appears delayed, lost, or damaged during shipping, customers should contact support@swey.me. Swéy may investigate the matter with the relevant courier. Any refund, replacement, store credit, or alternative remedy will be determined by Swéy after reviewing the circumstances and courier findings. No automatic entitlement to compensation arises solely because a parcel is delayed or reported as lost. Where the issue is caused by incorrect shipping information supplied by the customer, Swéy may refuse a refund, replacement, or free re-delivery.
29. Risk of Loss
Risk in the product transfers to the customer once delivery is completed to the address provided at checkout or once the courier confirms successful delivery. Where delivery is disputed, Swéy may consider courier records, tracking information, customer communications, delivery proof, and other relevant information before deciding on a remedy.
30. Returns, Refunds and Exchanges
Returns, refunds, exchanges, and store credits are governed by these Terms and our Refund, Returns & Exchanges Policy. Eligible return or exchange requests must be submitted within 14 calendar days of delivery. Requests submitted after this period may be refused.
31. Return Eligibility
To qualify for a return, exchange, refund, or store credit, the item must: ● Be unworn ● Be unused ● Be unwashed ● Be in original condition ● Have original tags attached ● Be free from stains, odours, perfume, smoke, pet hair, or damage Swéy reserves the right to inspect returned items before approving any refund, exchange, replacement, or store credit. Swéy may refuse any return that does not meet these requirements.
32. Size Exchanges
Size exchanges may be available where the customer selected the wrong size, subject to stock availability and return eligibility. Customers are responsible for reviewing the product size guide before ordering. Where a size exchange is requested, the customer may be responsible for return shipping costs unless Swéy determines otherwise. If the requested replacement size is unavailable, Swéy may offer store credit, an alternative size, an alternative product, or another remedy where legally required. A wrong size selection does not automatically entitle the customer to a refund.
33. Change of Mind
Swéy does not accept returns, refunds, or exchanges for: ● Change of mind purchases ● Products no longer wanted ● Colour preferences ● Orders placed by mistake ● Incorrect style selection ● Personal fit preference where the product is not defective ● Buyer’s remorse This does not affect any mandatory rights that cannot legally be excluded.
34. Damaged, Defective or Incorrect Items
If a customer receives an item that is damaged, defective, incorrect, or materially different from what was ordered, the customer must contact support@swey.me within 7 days of delivery. Photos, videos, packaging information, order details, and other evidence may be required for assessment. Where Swéy approves the claim, the customer may be offered one or more of the following remedies: ● Full refund ● Replacement item ● Store credit ● Repair or correction, where appropriate ● Alternative product, where agreed The remedy offered may depend on the nature of the issue, stock availability, legal requirements, and the circumstances of the order.
35. Return Shipping Costs
Customers are generally responsible for return shipping costs when: ● Requesting a size exchange ● Returning an item for a reason not caused by Swéy ● Returning a product due to customer error ● Returning a product where there is no confirmed defect Swéy may cover reasonable return shipping costs when: ● The incorrect item was sent ● The item arrives damaged ● A manufacturing defect is confirmed ● Swéy determines that covering return shipping is appropriate Return shipping arrangements must be approved by Swéy before the product is sent back.
36. Refund Processing
Approved refunds will be processed back to the original payment method where possible. Refund processing times may vary depending on Shopify, the payment provider, the customer’s bank, card issuer, or financial institution. Swéy is not responsible for third-party processing delays after a refund has been submitted. Original shipping charges are generally non-refundable unless required by law or unless Swéy determines otherwise.
37. Store Credit
Swéy may offer store credit as a remedy or alternative to a refund where appropriate. Store credit may be subject to expiry periods, usage limits, product restrictions, or other conditions where permitted by law. Store credit has no cash value unless expressly stated otherwise.
38. Sale, Discounted and Promotional Items
All sale, clearance, promotional, discounted, marked-down, or final sale items are considered final sale. Final sale items are not eligible for refunds, returns, or exchanges unless required by applicable law or where a manufacturing defect is confirmed. Discounted pricing does not create any additional return rights.
39. Promotional Codes, Discounts and Offers
Swéy may offer promotional codes, discounts, free shipping offers, giveaways, launch offers, referral rewards, or limited-time promotions. We reserve the right to amend, withdraw, refuse, suspend, or cancel any promotion at any time. Promotional codes may not be: ● Resold ● Duplicated ● Manipulated ● Used fraudulently ● Shared for commercial resale purposes ● Combined with other offers unless expressly allowed ● Used through bots, automated scripts, or abusive ordering behaviour If promotional abuse is suspected, Swéy may cancel orders, refuse discounts, disable codes, or restrict customer accounts.
40. Gift Cards and Store Credit
Where Swéy offers gift cards, vouchers, or store credit, additional terms may apply. Gift cards and store credit may not be redeemable for cash unless required by law. Swéy may refuse use of gift cards or store credit where fraud, misuse, or system abuse is suspected.
41. Customer Accounts
Customers may be able to create accounts through the website or Shopify checkout. You are responsible for maintaining the confidentiality of your account details. You agree not to share your login credentials or allow unauthorised access to your account. Swéy is not responsible for losses caused by unauthorised account use where the customer failed to take reasonable steps to protect account access.
42. Website Use
You agree to use the website only for lawful purposes. You may not: ● Interfere with website functionality ● Attempt unauthorised access ● Scrape, copy, or harvest data ● Use bots or automated systems ● Distribute malware ● Submit false information ● Impersonate another person ● Commit fraud ● Abuse promotions ● Interfere with checkout or payment systems ● Use the website in a way that damages Swéy or other users We reserve the right to restrict access where these rules are breached.
43. User Reviews, Photos and Submitted Content
Customers may submit reviews, photographs, comments, testimonials, feedback, product images, social media content, or other materials. By submitting content to Swéy or tagging Swéy in public content relating to our products, you grant Swéy a worldwide, royalty-free, non-exclusive licence to use, reproduce, publish, display, edit, share, and distribute such content for marketing, promotional, website, social media, advertising, and operational purposes. You confirm that any content you submit: ● Is your own content or you have permission to share it ● Does not infringe another person’s rights ● Is not unlawful, harmful, hateful, defamatory, or misleading ● Does not contain malware or harmful code Swéy may remove, edit, hide, or refuse any submitted content at its discretion.
44. Feedback and Suggestions
If you provide ideas, suggestions, improvements, designs, product concepts, feedback, or other recommendations to Swéy, you agree that Swéy may use them without restriction or compensation. Submitting feedback does not create any ownership right, payment right, employment relationship, partnership, or confidentiality obligation unless expressly agreed in writing.
45. Intellectual Property
All content on the Swéy Online Store is owned by or licensed to Swey Technologies (Pty) Ltd. This includes: ● The Swéy name ● Logos ● Product names ● Brand marks ● Website design ● Product designs ● Artwork ● Graphics ● Photographs ● Videos ● Written content ● Layouts ● Look and feel ● Marketing materials ● Product descriptions You may not copy, reproduce, modify, distribute, sell, imitate, exploit, or use Swéy intellectual property without prior written permission. Purchasing a product does not transfer ownership of any Swéy intellectual property rights.
46. Prohibited Commercial Use
You may not use Swéy products, images, logos, designs, or branding for unauthorised commercial purposes. You may not resell Swéy products in a way that misrepresents your relationship with Swéy or suggests official authorisation without written approval. Swéy reserves the right to take action against counterfeit, imitation, unauthorised resale, or brand misuse.

Personal information may be processed through Shopify, payment providers, courier partners, analytics tools, customer support tools, and other service providers used to operate the store. Transactional communications relating to orders, shipping, payment, refunds, returns, or customer support may still be sent even if you unsubscribe from marketing communications.

53. Limitation of Liability
To the maximum extent permitted by law, Swey Technologies (Pty) Ltd shall not be liable for: ● Indirect loss ● Consequential loss ● Incidental damages ● Loss of profit ● Loss of business opportunity ● Loss of data ● Website downtime ● Courier delays ● Customs delays ● Third-party payment issues ● Bank processing delays ● Customer ordering mistakes ● Incorrect shipping information supplied by the customer ● Delays outside our reasonable control Where liability cannot be excluded, Swéy’s liability will be limited to the maximum extent permitted by law. Where legally permitted, Swéy’s maximum liability for any claim relating to an order shall not exceed the amount paid by the customer for the specific order giving rise to the claim.
54. Indemnity
You agree to indemnify and hold harmless Swey Technologies (Pty) Ltd, its directors, employees, contractors, service providers, and partners from any claims, losses, damages, liabilities, costs, or expenses arising from: ● Your breach of these Terms ● Your misuse of the website ● Your fraud or unlawful conduct ● Your infringement of third-party rights ● Your submitted content ● Your incorrect information ● Your violation of applicable law
55. Force Majeure
Swéy will not be liable for any delay or failure to perform where such delay or failure results from events beyond our reasonable control. 56. Changes to Products and Services
Swéy may update, change, suspend, or discontinue any product, service, feature, policy, price, promotion, shipping method, payment method, or website function at any time. We are not liable to customers or third parties for modifying, suspending, or discontinuing products or services, except where required by law.
57. Changes to These Terms
Swéy may update these Terms from time to time. The updated version will be published on the website and will become effective from the date of publication unless otherwise stated. The version of the Terms published on the website at the time of purchase will generally apply to that transaction, unless a later version is required by law or expressly agreed. You may not transfer, assign, or delegate your rights or obligations under these Terms without Swéy’s written consent. Swéy may transfer, assign, or delegate its rights and obligations under these Terms in connection with a business transfer, restructuring, sale, merger, acquisition, or operational change.
59. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will remain in full force and effect. The invalid or unenforceable provision will be interpreted, modified, or removed only to the extent necessary.
60. No Waiver
If Swéy does not enforce a provision of these Terms immediately, that does not mean Swéy has waived the right to enforce it later. Any waiver must be in writing to be effective.
61. Entire Agreement
These Terms, together with the policies incorporated by reference, form the entire agreement between you and Swey Technologies (Pty) Ltd regarding the Swéy Online Store. They replace any prior understandings, communications, or agreements relating to the online store, unless expressly agreed in writing.
62. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa. Any dispute relating to these Terms, the website, or a purchase from the Swéy Online Store shall be subject to the jurisdiction of South African courts, unless applicable law requires otherwise.
